Welcome to the website of Octopus Project Management LLC (“Octopus PM,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your use of our website at octopm.com and any related services we provide, including but not limited to plumbing, mitigation, and construction services across Oregon and Washington. By accessing or using our website or engaging our services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use our website or services.
1. Company Overview
Octopus Project Management LLC is a restoration consulting firm and construction company headquartered at 15191 SW Royalty Pkwy K16, Tigard, Oregon. We provide plumbing, mitigation, and construction services to residential and commercial clients across twelve counties in Northwest Oregon and Southwest Washington, including Multnomah, Washington, Clackamas, Marion, Yamhill, Columbia, Clatsop, Tillamook, Clark, Cowlitz, Wahkiakum, and Skamania counties.
2. Services
Octopus Project Management provides plumbing, mitigation, and construction services as described on our website and in any service agreements entered into between you and our company. Our services include, but are not limited to, fixture installation, leak detection and repair, drain cleaning, water heater installation, trenchless pipe repair, water extraction, fire damage remediation, mold and microbial remediation, biohazard cleanup, asbestos testing, lead-based paint testing, abatement, general contracting, remodels, additions, drywall and framing, painting, cabinetry, roofing, flooring, and hardware installation.
The specific scope, timeline, and cost of any project will be outlined in a separate written estimate or service agreement provided to you before work begins. All estimates provided by Octopus Project Management are free and non-binding until a formal service agreement is executed by both parties.
3. Eligibility
By using our website or engaging our services, you represent that you are at least 18 years of age and have the legal authority to enter into a binding agreement. If you are acting on behalf of a business or other legal entity, you represent that you have the authority to bind that entity to these Terms.
4. Estimates and Pricing
Octopus Project Management provides free estimates for all plumbing, mitigation, and construction services. Estimates are typically provided within 24 hours of your initial inquiry. All pricing is based on the scope of work outlined in the estimate or service agreement and may be subject to change if the scope of work changes due to unforeseen conditions discovered during the project, additional services requested by the client, or changes in material costs or availability.
Any changes to the original scope of work or pricing will be communicated to you in writing before additional work is performed. We are committed to transparent pricing with no hidden fees.
5. Scheduling and Emergency Services
Our office and field crews operate Monday through Friday, 8 AM to 5 PM. Our emergency dispatch line is available 24 hours a day, 7 days a week, for urgent plumbing, water damage, fire damage, and other emergencies. Emergency services are available to homeowners and businesses throughout our twelve-county service area in Oregon and Washington.
Scheduled appointments are confirmed in advance. If you need to reschedule or cancel an appointment, please contact us at (503) 298-4534 or help@octopm.com as soon as possible. We reserve the right to reschedule appointments due to weather conditions, emergency calls, or other circumstances beyond our reasonable control.
6. Payment Terms
Payment terms will be outlined in your individual service agreement or estimate. Unless otherwise agreed upon in writing, payment is due upon completion of the agreed-upon work. For larger projects, a payment schedule may be established in the service agreement outlining milestone-based payments throughout the duration of the project.
We accept payment by check, credit card, and electronic transfer. If payment is not received within the timeframe outlined in your service agreement, Octopus Project Management reserves the right to suspend work until payment is brought current and charge a late fee as outlined in the service agreement.
7. Insurance Claims
Octopus Project Management works closely with insurance carriers throughout Oregon and Washington to help streamline the claims process for our clients. We provide detailed, room-by-room estimates designed to be transparent and easy for both homeowners and insurance adjusters to review. However, we do not guarantee that any insurance claim will be approved or that an insurance carrier will cover the full cost of any services. The client is ultimately responsible for any costs not covered by their insurance policy.
8. Warranties and Workmanship
Octopus Project Management stands behind the quality of our work. Specific warranty terms for plumbing, mitigation, and construction services will be outlined in your individual service agreement. Warranties apply to the workmanship performed by Octopus Project Management and do not cover damage caused by the client, third parties, natural disasters, normal wear and tear, or failure to follow our team’s maintenance recommendations.
Manufacturer warranties on materials and equipment installed by Octopus Project Management are separate from our workmanship warranty and are governed by the terms set by the respective manufacturer.
9. Client Responsibilities
As a client, you agree to provide accurate and complete information about your property and the nature of the work requested. You also agree to provide reasonable access to the work area as needed for our crews to perform services safely and efficiently, ensure that the work area is free from hazards not related to the scope of our work, communicate any known issues or concerns about the property that may affect the project, and make timely payments in accordance with the terms of your service agreement.
10. Limitation of Liability
To the fullest extent permitted by law, Octopus Project Management LLC, its owners, employees, agents, and subcontractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to the services we provide or your use of our website, regardless of the theory of liability.
Our total liability to you for any claim arising out of or related to our services shall not exceed the total amount you paid to Octopus Project Management for the specific project or service giving rise to the claim. Nothing in these Terms shall limit our liability for death or personal injury caused by our negligence or for fraud or fraudulent misrepresentation.
11. Intellectual Property
All content on the Octopus Project Management website, including text, images, logos, graphics, and design elements, is the property of Octopus Project Management LLC and is protected by applicable copyright, trademark, and intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on our website without our prior written consent.
12. Website Use
You agree to use our website only for lawful purposes and in a manner that does not infringe upon the rights of others or restrict their use of the website. You may not use our website to transmit harmful, offensive, or illegal content, attempt to gain unauthorized access to any part of the website or its systems, use automated tools to scrape, collect, or harvest data from the website, or misrepresent your identity or affiliation with any person or entity.

15. Dispute Resolution
In the event of any dispute arising out of or related to these Terms or the services provided by Octopus Project Management, both parties agree to first attempt to resolve the dispute through good-faith negotiation. If the dispute cannot be resolved through negotiation within 30 days, either party may pursue mediation or arbitration in accordance with the laws of the State of Oregon. Any legal proceedings shall be conducted in the courts of Washington County, Oregon, unless otherwise agreed upon in writing by both parties.
16. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Oregon, without regard to its conflict of law provisions. If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
17. Indemnification
You agree to indemnify, defend, and hold harmless Octopus Project Management LLC, its co-owners, employees, agents, and subcontractors from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your use of our website, your violation of these Terms, or your violation of any rights of another party.
18. Force Majeure
Octopus Project Management shall not be liable for any failure or delay in performing our obligations under these Terms or any service agreement if such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, severe weather, pandemics, government actions, supply chain disruptions, labor disputes, or utility failures. In the event of a force majeure situation, we will notify you as soon as practicable and work to resume services as quickly as possible.
19. Modifications to These Terms
Octopus Project Management reserves the right to update or modify these Terms at any time. Any changes will be posted on this page with an updated “Last Updated” date. Your continued use of our website or services after any changes to these Terms constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.
